The service offered by Garaje
Garaje provides a digital linking service between persons offering a parking space ("hosts") and persons wishing to park a vehicle ("passengers"). Garaje facilitates search, messaging, reservation and payment. The contract for making the place available is concluded between the host and the traveller.
The listings are classified mainly according to their availability on the requested dates and their proximity to the desired destination. The filters chosen by the user and, if applicable, the price sorting change this order. Publication of an advertisement is not fee-free and no preferential ranking is proposed.
Maps and itineraries can be provided by Google Maps Platform. Their use is also subject to Terms of use of Google Maps.
Registration and user obligations
The user shall provide accurate information, maintain the confidentiality of his or her identifiers and promptly report any unauthorized use. He must be of age and have the ability to contract. An account is personal and cannot be disposed of.
Garaje is not currently conducting a systematic documentary verification of the identity of travellers or a physical inspection of the sites. The listing information shall be declared by the host. Stripe can carry out its own statutory identity and bank account checks prior to payments to hosts.
The host guarantees that it has the right to propose the site, that the advertisement is true, that access is possible to the accepted dates and that use respects the lease, the condominium settlement and the regulations. The passenger shall use the space only for the declared vehicle and shall respect the premises and instructions of the host.
Reservations, fees and payments
The total price is displayed before validation: parking price fixed by the host, possible shuttle and Garaje service fee. The applicable service charges are those calculated and displayed in the order summary. The amounts presented at the time of the order shall prevail.
The payment is processed by Stripe. Garaje does not keep complete credit card data. Hosts must meet the identity and bank checks required by Stripe prior to any payment.
Cancellation
The traveller may cancel and obtain a full refund of the amount paid up to 48 hours prior to the scheduled start of parking. After this maturity, no automatic repayment is due, unless cancelled by the host, proved impossibility to provide the particular place or agreement validated by Garaje. The bank time to display the refund depends on the means of payment.
Right of withdrawal
Where the legal right of withdrawal applies to the service provided by Garaje, the consumer may exercise it within 14 days by writing to contact@garaje.fr. If he requests that the service commence before the end of this period, he may remain liable for the part performed. This right does not call into question the more favourable cancellation conditions mentioned above.
Your cover during a rental Garaje
The host and the traveller remain covered according to the guarantees provided by their own contracts. Prior to booking, they must report the rental to their insurers and have their property, liability, parking and, where applicable, shuttle coverage confirmed. Personal effects should not be left in the vehicle.
Role and limitations of Garaje
Garaje acts as a technical intermediary and does not own, monitor or operate the sites. Each user is responsible for his or her actions, information and the fulfilment of his or her commitments. Garaje may withdraw an advertisement, suspend an account or cancel a reservation in case of fraud, security risk, illegal content or violation of these terms and conditions.
Garaje shall use reasonable means to ensure the availability and security of the service, without ensuring uninterrupted operation. Nothing herein limits a liability that could not be legally excluded.
Use of the site
Users remain holders of their texts and photographs and grant Garaje a non-exclusive license, free of charge and limited to the duration of publication, to display and promote the advertisement. The brand, interface and content created by Garaje cannot be reproduced without permission.
False, discriminatory, dangerous or unlawful content, circumvention of payment, unauthorized automated extraction and any interference with the service or other users shall be prohibited.
Contact, mediation and applicable law
Any claim must first be addressed to contact@garaje.fr. Garaje has retained the Professional Mediation Society (SMP), Alteritae, 5 rue Salvaing, 12000 Rodez, France — mediator-consumption-smp.frThe referral, free of charge to the consumer after a prior written complaint, will be opened as soon as the Garaje Accession Convention takes effect.
These conditions are subject to French law. The mandatory rules protecting the consumer and the legal rules of jurisdiction remain applicable.
Changes in conditions
Garaje can modify these conditions to adapt the service or comply with the law. The version applicable to a reservation is the one accepted at the time of validation. A significant change will be brought to the attention of the users concerned.
